In a divorce, the calculation starts from the assets being divided; in a custody case, no assets are divided. In an inheritance, from your own share of the caudal (estate). A will has a fixed price.

What is there to divide?

The gananciales (community property): real estate, accounts, vehicles. Enter their total value, without deducting mortgages or debts: the tariff of the procurador (court representative) is calculated on the gross assets. With nothing to divide, enter 0.

Child maintenance or pensión compensatoria (compensatory payment to the other spouse), added up over one year. If either is claimed in a contested divorce, or approved in a mutual-consent one, the procurador (court representative) also charges the scale on that year's total. With no payments, leave 0.

How it is worked out

Two different prices, from two different people.

The abogado (Spanish lawyer): fixed price

You pay it to us, with an invoice, and VAT is already included. A divorce by mutual consent costs at least €500. If there are gananciales (community property) to divide, it adds the same amount as the maximum tariff of the procurador (court representative) for them, VAT included, and stops rising once it reaches twice everything the procurador charges at the tariff maximum; it never goes below €500. The amount in euros is fixed in the engagement letter, based on the value of the assets that we agree when you sign it. A contested divorce, custody cases and wills have a fixed price; an inheritance, 3% of your share of the net caudal (estate).

The procurador (court representative): maximum tariff

In a divorce before the court, the law requires both an abogado (Spanish lawyer) and a procurador (court representative), under art. 750 LEC; if it is by mutual consent, you can both use the same abogado and the same procurador. The procurador charges at most the tariff in Real Decreto 434/2024, gives you a quote beforehand and invoices you directly: that money does not pass through us.

The part that varies depends on the assets: if they are gananciales (community property), a percentage of the art. 2 scale on their total value (the gross assets, without deducting debts); if what you own together has to be divided in court, the full scale.

Scale figures exclude VAT. The tariff is a maximum: the procurador (court representative) can agree a lower price with you and is required to give you a quote beforehand (arts. 1.3 and 3 of RD 434/2024), with a cap of €75,000 per matter (art. 1.4). Disbursements — official fees, postage and other costs they pay out on your behalf — are separate (art. 15 of the tariff); paper copies, at most €0.22 per page (art. 12).

What the price includes, and what it does not.

Divorce

  • The convenio regulador (divorce settlement agreement), drafted with both of you, in a mutual-consent divorce.
  • In a contested divorce, the prior negotiation the law requires before going to court (art. 5 LO 1/2025), except where there are criminal proceedings or a protection order between you for gender-based or sexual violence: in that case the law prohibits it (art. 89.9 LOPJ).
  • The petition, and filing it with the court.
  • The ratification or the hearing, and the judgment.
  • Registration of the divorce at the Registro Civil (Civil Registry).
Not included

The procurador (court representative), who invoices separately at the official tariff. If the divorce or the division is signed before a notary, the notary and, if real estate is allocated, the Registro de la Propiedad (Land Registry), which have their own official tariffs. Interim measures, liquidation of the gananciales (community property) or division of jointly owned property in separate proceedings, and enforcement of the judgment, which are quoted separately. Appeals. Sworn translations of foreign documents.

Custody

  • The measures for minor children — custody, visiting rights, maintenance and, if there is one, use of the family home — agreed with both of you (mutual consent).
Not included

The procurador (court representative), who invoices separately at the official tariff. The division of assets, which is not part of this service. Interim measures, modification of measures already set by a judgment, enforcement of the judgment and appeals, which are quoted separately. Sworn translations of foreign documents.

Inheritance

  • The death certificate and the certificate of last wills.
  • Acceptance of the inheritance and its partition among the heirs.
  • The deed, coordinated with the notary.
  • Filing the returns for inheritance tax (impuesto de sucesiones) and the plusvalía municipal (local land-value tax).
  • Registration at the Land Registry.
Not included

The notary and the Land Registry, which have their own official tariffs. Inheritance tax (impuesto de sucesiones) and the plusvalía municipal (local land-value tax), which are paid to Hacienda (the Spanish tax office) and to the town hall. If the heirs cannot agree and the estate has to be divided by the court, that is quoted separately.

Will

  • The draft, prepared with you and reviewed before signing.
  • Coordinating the signing with the notary.
  • If you ask, the appointment of our abogado (Spanish lawyer) as contador-partidor (estate partitioner), for €70 more.
Not included

The notary, who has their own official tariff. The fees of the contador-partidor (estate partitioner) if the role is actually exercised: 3.5% of the caudal (estate) divided, charged to the estate.

Questions we get asked.

Why is there a procurador (court representative) if I already have an abogado (Spanish lawyer)?

Because in a divorce before the court the law requires both: the abogado (Spanish lawyer) defends your interests and the procurador (court representative) represents you (art. 750 LEC). If it is by mutual consent, three months have passed since the wedding and there are no unemancipated minor children, nor children with support measures assigned to you, it can also be done before a notary, with an abogado and without a procurador (arts. 82 and 87 CC): we tell you which route suits you.

Why does a divorce by mutual consent cost more when there are more assets?

Because dividing more property takes more work. It starts from €500, which is the minimum, and adds the same amount as the maximum tariff of the procurador (court representative) for those assets, VAT included; it stops rising once it reaches twice everything the procurador charges at the tariff maximum. Maintenance payments do not increase it. The amount in euros is fixed in the engagement letter, based on the value of the assets that we agree when you sign it. The calculator shows you the breakdown.

What do I enter if there are no assets to divide?

Zero. With no assets to divide there is no charge for the liquidation: the procurador (court representative) charges the fixed part and, if maintenance or a pensión compensatoria (compensatory payment to the other spouse) is claimed (contested) or approved (mutual consent), the scale applied to one year of payments. The calculator reflects this.

What if we are not married, or we are under separation of property?

Choose “Jointly owned assets” in the calculator. That division is not a liquidation of gananciales (community property): with agreement it is signed before a notary, with no procurador (court representative); without agreement it goes through a division of jointly owned property (art. 400 CC), and there the procurador can charge the full art. 2 scale of the tariff, plus 10% if it is ordinary proceedings (art. 18.d), not the 25% or 50% that applies to gananciales.

When is the custody service enough?

When you are not married and custody, visiting rights and maintenance for your minor children have to be set for the first time (art. 748.4 LEC), with no division of assets. If you are married, they are normally set in the separation or divorce: we tell you before you engage us whether this route works for you. If a judgment has already set them, changing them is a modification of measures, which is quoted separately. By mutual consent it costs €500, the same as a divorce by mutual consent with no assets; contested, €2,037: €363 less than a contested divorce, VAT included (€300 plus VAT).

What does a contador-partidor (estate partitioner) do?

They divide the estate when the heirs cannot agree, without anyone having to go to court for a judicial division. The testator appoints them, and it cannot be one of the heirs (art. 1057 CC). If you appoint us in your will, their fees are set in it: 3.5% of the caudal (estate) divided, VAT included, charged to the estate.

What is the inheritance fee calculated on?

On your share of the net caudal (estate): the inherited assets, less debts and charges. If the caudal is €1,000,000 and you receive €400,000, the 3% applies to €400,000. If you are the sole heir, to the whole caudal. The amount in euros is fixed in the engagement letter, based on the valuation of your share that we agree when you sign it.

Prices include VAT. Our fees are the published ones and are written into your engagement letter; whatever depends on third parties — procurador (court representative), notary, Land Registry, taxes — is an estimate.
